The family mediation

The civil mediation is developed mainly by bodies working in intra-judicial family mediation, but it can also be successfully applied to disagreements on contracts, mercantile relationships, in the scope of consume or horizontal property.

The family mediation improves the quality of judicial answers and the future of people carrying it out, separated or divorced, and, particularly, the future of their children. 

WHAT ARE THE AIMS OF FAMILY MEDIATION?

  • Building up relationships and encouraging communication, improving psychological and personal satisfaction.
  • Decreasing the tension and fostering peaceful behaviours, encouraging cooperation.
  • Limiting the negative consequences for the children, making it easier to:
    • Endure the new family situation.
    • Guarantee their right and need to have both parents.
    • Avoid feelings of guilt.
    • Provide them with information adapted to their age.
  • Allow that the parties assume their responsibilities.
  • Adjust the agreements or choices to the real needs.
  • Avoid feelings of looser/winner.
  • Encourage flexibility and cooperation to tackle changes.
  • Diminish the affective, economic and timing costs.
  • Achieve a high degree of observance of judicial decisions. 

HOW CAN ONE TAKE PART IN THE FAMILY MEDIATION PROJECT?

  • So that a judicial body can take part in the project, it should count on institutional cooperation (autonomous communities, town councils, bar associations...) which will financially allow counting on a certified group of mediation professionals, as well as having a proper place for celebrating meetings.
  • Communicating the General Council of the Judiciary, through its Service of Planning and Analysis of Judicial Activities, the will to take part in the project.
